Death Penalty Now an Option in Supermarket Stabbing

Special circumstance allegations are added to murder charge in case against man accused of stabbing his wife at a Santa Monica Albertsons in August 2011.

Two special circumstance allegations that could result in the death penalty have been added against a man accused of fatally stabbing his estranged wife last summer at the at 3105 Wilshire Blvd.

Kelvin Melvin Green, who will turn 53 next Monday, is charged in the Aug. 21, 2011, attack on Christina Talley, .

The murder charges that were filed Aug. 26 now include special circumstance allegations that Green intentionally killed Talley by means of lying in wait and that the murder was committed while he was engaged in the crime of mayhem, according to Deputy District Attorney Amy Carter.

Green was initially identified as a person of interest, then ultimately determined to be a suspect in the 46-year-old woman's slaying, according to Santa Monica police. to the murder charge after his arrest Aug. 22.

Along with one count of murder, Green faces one count of assault involving a good Samaritan who tried to intervene but was not injured, according to the District Attorney's Office.

His next court date is April 2 at the Airport Branch Courthouse in Los Angeles.
