Motorcyclist Who Crashed Charged With DUI

Authorities say the Apple Vally man, on parole for a burglary conviction, tried to escape police who responded to a crash Friday night near Main Street.

Authorities are accusing an Apple Valley man of trying to run from officers who responded to a motorcycle crash late Friday night at Neilson Way and Pier Avenue.

Codey Elgie Foy, 35, pleaded not guilty Tuesday to four felony charges in connection with the incident, including driving with a blood alcohol content above .08 percent and grand theft.

Police and prosecutors allege Foy, who was on parole for a recent burglary conviction, stole the motorcycle before crashing it shortly before 11 p.m. Friday.

The first officer to arrive was a sergeant, who immediately called for back up when Foy tried "to push the motorcycle onto the sergeant's leg," Santa monica Police Sgt. Richard Lewis said.

"A fight ensued and upon the arrival of additional officers, the suspect was taken to the ground, where, after a lengthy struggle, he was handcuffed and placed in the backseat of a patrol vehicle," he said. According to Lewis, Foy tried to escape from the car by kicking the rear window.

During the fight, Foy allegedly dropped a knife, screwdriver, wire cutters and a metal filer. Foy, whose face is visibly scuffed in his booking photo, and the sergeant sustained minor injuries.
